Digital Millennium Copyright Act (DMCA) Policy

Better Broccoli Cheddar respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Better Broccoli Cheddar website and/or services (the "Service") if such claims are reported to our Designated Copyright Agent identified below.

Filing a DMCA Infringement Notice

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Service by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent. Upon receipt of the Notice as described below, Better Broccoli Cheddar will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Service.

  1. Identification of the copyrighted work claimed to have been infringed: Provide details sufficient to identify the copyrighted work(s) you claim have been infringed. This includes a description of the work and, where possible, a copy or the location (e.g., URL) of an authorized version of the work.
  2. Identification of the material claimed to be infringing: Provide details sufficient to identify the material that you claim is infringing and its location on the Better Broccoli Cheddar Service. This includes the URL(s) of the pages on the Better Broccoli Cheddar website where the infringing material is located.
  3. Contact Information of the Complaining Party: Provide your full legal name, mailing address, telephone number, and email address.
  4. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Physical or electronic signature of the complaining party.

Filing a DMCA Counter-Notification

If you believe that your content, which was removed or disabled, is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notice containing the following information to our Designated Copyright Agent:

  • Identification of the material that has been removed or to which access has been disabled: Provide the URLs where the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your Name, Address, Telephone Number, and Email Address.
  • A statement that you consent to the jurisdiction of the federal court in the state of [Insert Relevant State, e.g., California] and a statement that you will accept service of process from the person who provided notification of the alleged infringement.
  • Your physical or electronic signature.

Upon receipt of a valid counter-notice, Better Broccoli Cheddar will send a copy of the counter-notice to the original complaining party informing that person that Better Broccoli Cheddar may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at our sole discretion.
